ORDER

The case of the complainant is that he purchased one Maruti Desire car from the  dealer of OP.   As per complainant the OP issued a cheque of Rs.35,477.10 payable at HDFC Bank Ltd.  as Rebate of Excise Duty in favour of the complainant.  The said cheque was lost by the complainant and he lodged a police complaint to this effect.  Thereafter the complainant  requested the OP to issue a fresh cheque. The grouse of the complainant is that the OP got all the formalities completed from complainant but did not issue the cheque.

The dispute involves a small issue, therefore, without prolonging the litigation, we direct the OP to issue fresh cheque to the complainant within one month from the date of receipt of certified copy of the order failing which the OP shall be liable to pay additional amount of  Rs.25,000/- to the complainant .  In case the complainant is not satisfied  then he would have the liberty  to file a fresh complaint.

Certified copy be sent to the parties free of charge. After compliance file be consigned.
