          The case of the complainant as we find from the record in short is that complainant purchased a car on 22.3.11 from o.p. and at the time of purchase they charged Rs.10,133/- for insurance but o.p. gave insurance policy of Rs.5505/- to the complainant and further charged Rs.7990/- for sound system and A.C. which complainant did not order at all nor received.

            Further case of the complainant is that o.p. with an intention to cheat all these things and for which complainant had to be harassed for about a month and had to be subjected to mental tension and agony for one year. Hence the case was filed by the complainant with the prayer contained in the petition of complaint.

            Sole O.p. did not contest this case by filing w/v and as such matter was heard ex pate against the o.p.

Decision with reasons:

            We have gone through the pleadings of the complainant, evidence and documents in particular. The evidence adduced by complainant has remained unchallenged testimony since o.p. has not come forward to contest the case and to rebut the evidence of the complainant and as such, we hold that the complainant has been able to substantiate and establish his case and is entitled to relief.

            Hence, ordered,

            That the case is allowed ex parte with cost against the o.p. O.p. is directed to pay to the complainant a sum of Rs.20,000/- (Rupees twenty thousand) only as compensation for harassment and mental agony and litigation cost of Rs.2000/- (Rupees two thousand) only within 45 days from the date of communication of this order, i.d. an interest @ 10% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.
