This complaint is filed under Sec. 35 of the Consumer Protection Act, 2019 and the matter stood over to this date for consideration. After hearing the matter this Commission passed an order as follows:
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint, notice was issued to the opposite parties. The notice issued to opposite parties 1 & 2 served on 20.05.2023 and they entered appearance on 06.06.2023. Opposite parties 1 & 2 also filed written version. As the notice issued to opposite parties 3 & 4 were returned with the endorsement ‘no such person’, the complainant was directed to take steps against opposite parties 3 & 4. The second notice to opposite parties 3 & 4 issued from this Commission was also returned with the endorsement ‘addressee left’. Again the complainant was directed to take steps against opposite parties 3 & 4. After filing this complaint, the complainant was continuously absent and there was no representation on any of the posting dates till this date. The complainant also failed to take steps against opposite parties 3 & 4. When the case came up for consideration today, the complainant was absent and there was no representation. Opposite parties 1 & 2 represented. As the complainant has not taken steps against opposite parties 3 & 4, we find that this is a fit case to be dismissed.
In the result, the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
