Date of filing : 28-11-2006 Date of Order : 4-8-2008 IN THE CONSUMER DISPUTES REDRESSAL FORUM, KASARAGOD CC.No.135/06 Dated this, the 4th day of August 2008 PRESENT SRI.K.T.SIDHIQ : PRESIDENT SMT.P.RAMADEVI : MEMBER SMT.P.P.SHYMALADEVI : MEMBER Parameshan.T.V, S/o.Chirukandan, R/at Kattur, } Complainant Kokeath.Po, Pin: 671 537. Marketing Manager, Zain Motors, Authorised Dealer, } Opposite party Chandragiri Bridge, Kasaragod. O R D E R SRI.K.T.SIODHIQ,PRESIDENT Parameshan booked an Autorikshaw with Marketing Manager, Zain Motors, Kasaragod by advancing Rs.2500/-. Later he cancelled the booking and claimed refund. But Zain Motors refused to refund the advance he paid. Hence the complaint claiming refund of Rs.2500/- with compensation of Rs.25,000/- and cost of Rs.5000/-. 2. Marketing Manager, Zain Motors filed version and according to them the Autorikshaw booked was ready for delivery but Parameshan was not willing to take develivery. However as a matter of fair trade practice they are ready to refund Rs.2580/- to Parameshan. In view of the above admission, the Marketing Manager, Zain Motors, Kasaragod is directed to refund Rs.2500/- along with cost of Rs.500/- to Parameshan. Time for compliance 30 days from the date of receipt of copy of the order. Failing which Rs.2500/- will carry interest @ 12% per annum from the date of complaint till the date of payment.
