JUDGMENT
 
JUSTICE SRI.K.R.UDAYABHANU    : PRESIDENT
 
          The appellants are the opposite parties in OP.173/03 in the file of CDRF, Kottayam. The appellants have called in question the order of the Forum cancelling the disconnection notice issued by the opposite parties and also to pay Rs.500/- as costs.
          2. It is the case of the complainant that she is having telephone connection No.2370401 obtained in February, 2003 in the MP quota. The husband of the petitioner is having 3 other telephones.  He was conducting a telephone booth also. The notice has been issued to disconnect her telephone as her husband has not paid the dues amounting to Rs.16951/-.
          3. The opposite party/appellants have asserted their right for  disconnection of her telephone on the basis of Rules 443 of the Telegraphic Rules.
          4. We find that the division bench of the High Court in Radhakrishnan.P.V  vs. General Manager, BSNL, 2002 (2) KLT 241 has disapproved such right as emanating from Rule 443. In the circumstance we find that order of the Forum is justified. Hence the appeal is dismissed.
