This appeal has been directed against the order dated 15.03.2017 passed by the District Forum, Haridwar in consumer complaint No. 225 of 2011, whereby the District Forum has allowed the consumer complaint ex-parte against the appellant – opposite party No. 3 and directing him to pay compensation of Rs. 4,90,000/- to respondent No. 1 – complainant together with litigation expenses of Rs. 5,000/-.
During the pendency of the appeal, the appellant and respondent No. 1 – complainant have entered into compromise and a joint compromise application has been filed by the appellant – Sh. Bhanu Pratap Singh through his counsel Sh. Susheel Kumar and respondent No. 1 – complainant Sh. Manveer.
According to the compromise deed, the appellant shall continuously keep respondent No. 1 in service and shall provide all service benefits to him. It has further been agreed that the complainant shall not claim the compensation awarded by the District Forum.
The respondent No. 1 – complainant is present in person before us and he has stated that this compromise deed has been executed by him with free mind and without any duress or coercion and that he does not want to claim the compensation awarded by the District Forum per impugned order.
In view of the settlement arrived between the appellant and respondent No. 1, appeal is hereby disposed of. Order impugned dated 15.03.2017 passed by the District Forum is set aside. The compromise deed shall form part of the order. The statutory amount of Rs. 25,000/- deposited by the appellant at the time of filing the appeal, be released in its favour.
