ORDER

By Smt. Padmini Sudheesh, President: Petitioner’s case is as follows: Petitioner had joined in two kuries in the respondent firm for Rs.1,20,000/- each as per pass book No.413 and 414. The kuries had been prized to him and he had deposited the prized amount with 15% and 14% interest. The kuri amount was paid out of the interest. The duration of the kuries were completed on 7.2.05 but the deposited amount is not received so far. The manager made the petitioner to put signature on some vouchers and forms. He did it. The amount is not received. Hence this complaint. 2. The counter is as follows: This complaint is not maintainable since there are two kuries. It is incorrect to state that Rs.1,20,000/- had deposited. The interest rate stated is not correct. Hence dismiss. 3. The points for consideration are: (1) Whether the petitioner is entitled for the deposited amount? (2) Is there any deficiency in service? (3) Reliefs and costs. 4. The evidence consists of Exts. P1, P2 series, P3 to P5. No evidence from the respondent. 5. Points-1 to 3: The definite case of the petitioner is that he had joined in two kuries and he had prized and the prized amount had deposited. The kuri instalment was paid out of the interest. The period of kuries was also completed. But the deposited amount is not returned. The respondent has no case that the entire amount adjusted to the kuri. How much amount is taken from the deposit is also not stated by the respondent. Hence the complainant is entitled for the amount sought. 6. In the result, the complaint is allowed and the respondent is directed to return an amount of Rs.2,40,000/- (Rupees two lakhs and forty thousand only) with interest at the rate of 14% per annum from 7.2.05 and 6% from today till realisation. Comply the order within two months. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 29th day of July 2008.
