ORDER NO. 1 DT. 16.3.11

Misc. Applicant is present through Mr. S.Roy Chowdhury, Ld. Advocate. 

The record is placed today for passing necessary orders in respect of this Misc. Application.  We have duly perused the application and the materials on record and find that at the time of filing of the Appeal the Appellant deposited Rs. 11,023/- through Bank Draft.  Now, In view of the order dt. 10.2.10 passed by the Executing Forum, Kolkata Unit-II in Execution Case No. 42/2009 the Appellant may be permitted to withdraw the deposited money which was deposited U/S 15 of the Consumer Protection Act, 1986 at the time of filing of the Appeal and is at liberty to approach the Registrar of this Commission for the purpose.  The M.A. is accordingly disposed of.
