                             Today is fixed for admission hearing.

                             Ld. Adv. for the complainant is present.

                             Case is taken up for admission hearing.

                             Hd. Ld. Adv. for the complainant.

                             Perused  the petition of complaint.

                             Perused the Xerox copies of documents filed by the complainants.

                             Complainants filed this complaint u/s 35 of Consumer Protection Act, 2019 against the aforesaid  opposite party praying for direction to the OP to give lift in the flat and generator and CC TV Camera and to give new pluster and also  praying for compensation amounting to Rs.3,00,000/- and other reliefs.

                             Petitioners alleged in the complaint that OP was agreed to provide lift, generator and CC TV Camera in the apartment under which the aforesaid flats are situated. Perused the copy of sale deeds filed by the complainant.

                             On perusal of sale deed by which petitioner Shyam Jaiswal purchased one flat.

                             Ld. Adv. for the complainant referred the page no.5 of the said deed. He argued that in the said deed in the page no.5 it has stated “Construction of Multi-storeyed building” that means OP was agreed to provide lift, generator and CC TV Camera.

He also referred page no.6 wherein it has mentioned “Common right of airways, common passages, drains, water courses, common areas and facilities together with the benefits and other rights of easement etc.” He further argued that these entry means OP was agreed to provide CC TV Camera, generator and lift.

          On careful scrutiny of the aforesaid sale deeds and other sale deeds, we find that there is no note that OP was agreed to provide lift, generator and CC TV Camera in the apartment where aforesaid flats are situated.

          In view of the aforesaid discussion, we find no prima facie  case to go  to trial.

 

          As the complainants fail to show their prima facie case, hence, we think that present case should not be admitted.

                                                          Ordered

                                                                             that the present case be and the same is dismissed being not admitted.
