2. Sh. Ashish Naik, Advocate has put in appearance on behalf of the respondent/ complainant and filed his Vakalatnama, which is taken on record.
3. Vide order dated 20.05.2016, for not putting in appearance before District Consumer Disputes Redressal Forum-I, UT, Chandigarh (in short ‘the Forum’) for the date fixed i.e. 20.05.2016 and for not filing reply and evidence, the Revision Petitioners (Opposite Parties) were ordered to be proceeded against exparte.
4. It is stated by Sh.Raman Walia, Advocate, Counsel for the Revision Petitioners that he could not appear on account of wrong noting down of the date.
5. Be that as it may, at the time of arguments, Sh. Ashish Naik, Advocate, Counsel for the respondent/complainant very fairly states that let the order, under challenge, be set aside and the matter be heard on merits.
6. Sh.Raman Walia, Advocate, Counsel for the Revision Petitioners undertakes to file reply and evidence in the Registry of the Forum within 10 days from today and supply copies of the same to the Counsel opposite.
7. Parties are directed to appear before the Forum concerned on 11.07.2016.
8. It is made clear that in case reply and evidence is not filed by the Revision Petitioners, before the Forum, within the time stipulated, aforesaid, no further adjournment shall be granted and this Revision Petition shall be deemed to have been dismissed.
9. Order passed is subject to payment of Rs.5,000/- as cost, which will include the cost already imposed by the Forum. The said amount of cost shall be paid by the Revision Petitioners/Opposite Parties to the respondent/complainant before the Forum on the next date of hearing.
10. Certified copies of this order be sent to the parties, free of charge.
11. Complete record alongwith a certified copy of this order be sent to the Forum, immediately, so as to reach there before the date fixed.
12. File be consigned to the Record Room after completion.
