      The record is put up today as per put up petition.

      Ld. Advocate for the Complainant files a petition with the prayer for dismissal of the instant case as the Complainant is not willing to proceed with the case. She further submits that the OP has filed Demand Draft dated 27.03.23 amounting to Rs. 3,88,800/- to satisfy the claim of the Complainant and the Complainant is willing to accept the said Demand Draft as full and final satisfaction. Ld. Advocate for the OP submits that as per demand of the Complainant they have submitted the Demand Draft amounting to Rs. 3,88,800/-. They have no objection if the case be dismissed.

      After hearing both sides, we peruse the materials on record. The Complainant is willing to withdraw the case as the OP has deposited the aforesaid DD in connection with the claim of the Complainant. Such being the position, this District Commission is not willing to interfere with the decision of the parties.

    Hence, it is

                                             

                                    Ordered

that the instant case being No. CC/174/2018 be and the same is dismissed as withdrawn but under the circumstances without any order as to costs.

    Let the Demand Draft dated 27.03.23 amounting to Rs. 3,88,800/- deposited by the OP be handed over to the Ld. Advocate for the Complainant on proper verification and identification. The petition filed by the Complainant praying for withdrawal of the said demand draft is thus disposed of.

     Let plain copy of this order  be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand  /by post under proper acknowledgment  as per rules, for information and necessary action.
