This Opposite Parties’ appeal is directed against the order dated November 2nd, 2015 passed by District Consumer Disputes Redressal Forum, Panipat   (for short ‘the District Forum’).

2.      Manohar Lal-Complainant/respondent, purchased two Kissan Vikas Patra (for short ‘KVPs’), bearing No.475667 and 475668 dated August 27th, 2005 of Rs.10,000/- each, from Head Post Office-Opposite Party/appellant No.1. The KVPs matured on March 27th, 2014. On August 19th, 2014 the respondent handed over the above said KVPs to the appellant No.1 and the appellant assured the respondent that the amount would be transferred to his Saving Account but the amount was not transferred.  The respondent visited the appellant No.1 to know the fate of the KVPs in question but it was stated that the KVPs were never handed over by the respondent. The respondent was advised to get the amount by applying for duplicate KVPs.  Hence, complaint under Section 12 of the Consumer Protection Act, 1986 was filed before the District Forum.

3.      After evaluating the pleadings and evidence of the parties, the District Forum accepted complaint and directed the appellants to pay the amount of KVPs to the respondent and Rs.2200/- litigation expenses.

4.      Phool Singh, Assistant Superintendent of Posts, who is present in person, has stated that the appellants are ready to issue duplicate KVPs within three days and pay the amount in case the respondent applies for it. The respondent has stated that he has already applied but neither the KVPs were issued nor the amount was paid.

5.      Be that as it may, the respondent is at liberty to file another application to the appellants and the appellants shall issue the duplicate KVPs and make the payment within thirty days to the respondent.

6.      The appeal is dismissed with cost of Rs.5,000/- besides Rs.2200/- imposed by the District Forum.   

7.      The statutory amount of Rs.21,100/- deposited at the time of filing the appeal be refunded to the appellants, against proper receipt and identification in accordance with rules after the amount of KVPs and cost is paid to the complainant.
