1. With the efforts of National Lok Adalat, the parties have settled the matter. Vide his separate statement, Sh.Manmohan Sharma, Advocate Proxy for Sh.Nitesh Singhi, Advocate for OPs has stated that the matter has been settled between the parties and as per settlement, the OPs have agreed to pay an amount of Rs.25,00,000/- to the complainants in full and final settlement of the present matter, out of which one cheque No.122835 dated 15.01.2024 amounting to Rs.4,16,667/- in the name of complainant No.1 Viney Kumar; second cheque No.122838 dated 27.01.2024 amounting to Rs.4,16,666/- in the name of complainant No.2 Rajiv Sharma; third cheque No.122837 dated 25.04.2024 amounting to Rs.4,16,667/- in the name of complainant No.1 Viney Kumar; fourth cheque No.122834 dated 27.04.2024 amounting to Rs.4,16,667/- in the name of complainant No.2 Rajiv Sharma; fifth cheque No.122839 dated 25.05.2024 amounting to Rs.4,16,666/- in the name of complainant No.1 Viney Kumar and sixth cheque No.122836 dated 27.05.2024 amounting to Rs.4,16,667/- in the name of complainant No.2 Rajiv Sharma, all drawn on Bank of Maharashtra, have been handed over to Sh.Yogesh K.Puri, Advocate for Complainants. It has been further stated by Sh.Manmohan Sharma, Advocate, that on payment of the aforesaid cheques, the complainants shall not have any right, title or interest in the property in question and the documents in original, if any, with regard to property in question will be returned by the complainants to the OPs at the time of last payment. It has been further stated by him that in case of dishonour of any of the above cheque, the OPs will clear the cheque amount within 7 working days from the date of dishonour of the cheque, failing which defaulted amount shall be paid alongwith interest @ 12% p.a. from the date of default till the payment is made. Vide his separate statement, Sh.Yogesh K.Puri, Advocate for Complainants has admitted the aforesaid statement of Sh.Manmohan Sharma, Advocate Proxy for Sh.Nitesh Singhi, Advocate for OPs and prayed that the complaint be disposed of in terms of aforesaid settlement. Photocopy of cheques has been placed on record as Ex.CX. 2. In view of the statements made by counsels for the parties, the complaint is disposed of being settled. Both the parties shall be bound by the statements made today before the National Lok Adalat. The award is accordingly passed. 3. Certified copies of this order be sent to the parties free of cost. The file be consigned. |
