AWARD

1.   Vide his separate statement recorded on 05.12.2023, Sh.Nitesh Singhi, Counsel for OPs has stated that the matter has been settled between the parties and as per settlement, the OPs have agreed to pay an amount of Rs.30,00,000/- to the complainants in full and final settlement of the present matter, out of which one cheque No.122864 dated 15.01.2024 amounting to Rs.10,00,000/-; second cheque No.122865 dated 15.04.2024 amounting to Rs.10,00,000/- and third cheque No.122863 dated 31.05.2024 amounting to Rs.10,00,000/-, all cheques in the name of complainants drawn on Bank of Maharashtra, have been handed over to the complainants. It has been further stated by counsel for OPs that on payment of the aforesaid cheques, the complainants shall not have any right, title or interest in the property in question and the documents in original, if any, with regard to property in question will be returned by the complainants to the OPs at the time of last payment. It has been further stated by counsel for OPs that in case of default of any payment, the defaulted amount shall be paid alongwith interest @ 12% p.a. from the date of default till the payment is made. Vide their separate statement recorded on 05.12.2023, Mrs.Madhu Aggarwal and Sh.Ankit Aggarwal, Complainants have admitted the aforesaid statement made by counsel for OPs and prayed that complaint be disposed of in terms of aforesaid settlement in the National Lok Adalat.

2.   In view of the statements made by counsel for OPs as well as complainants, the complaint is disposed of being settled. The parties shall be bound by their statements made on 05.12.2023. The award is accordingly passed.

3.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
