CONSUMER COMPLAINT NO. 689  OF  2021

ORDER

1.   At this stage, the matter has been settled between the parties. Vide his separate statement, Sh.Nitesh Singhi, Counsel for OPs has stated that the matter has been settled between the parties with the term that OPs shall pay lump sum amount of Rs.25,77,300/- to the complainant in four installments towards full and final settlement in the present matter, out of which first installment of Rs.6,44,325/- will be paid on or before 25.09.2023; second installment of Rs.6,44,325/- will be paid on or before 25.10.2023; third installment of Rs.6,44,325/- will be paid on or before 25.11.2023 and fourth installment of Rs.6,44,325/- will be paid on or before 25.12.2023 and the aforesaid amount of installment shall be transferred in the bank account of the complainant straightway through electronic mode. It has been further stated by counsel for OPs that on the payment of entire amount, the complainant shall not have any right, title or interest in the property in question and the documents in original, if any, with regard to property in question will be returned by the complainant to the OPs at the time of last payment. It has been further stated by counsel for OPs that in case of any default in payment, the defaulted amount shall be paid alongwith interest @ 12% p.a. from the date of default till the payment is made. Vide his separate statement, Sh.Sandeep Bhardwaj, Counsel for Complainant has admitted the aforesaid statement of Counsel for OPs and prayed that the complaint be disposed of in terms of aforesaid settlement. Counsel for Complainant has also prayed that the aforesaid amount may kindly be transferred straightway into the following bank account of the complainant:-

2.   In view of the statements of the counsel for the parties and in terms of the settlement, the complaint stands disposed of by passing the following order:-

1. OPs shall pay lump sum amount of Rs.25,77,300/- to the complainant in four installments towards full and final settlement in the present matter, out of which first installment of Rs.6,44,325/- will be paid on or before 25.09.2023; second installment of Rs.6,44,325/- will be paid on or before 25.10.2023; third installment of Rs.6,44,325/- will be paid on or before 25.11.2023 and fourth installment of Rs.6,44,325/- will be paid on or before 25.12.2023 and the aforesaid amount shall be transferred in the aforesaid bank account of the complainant straightway through electronic mode.
2. On the payment of entire amount, the complainant shall not have any right, title or interest in the property in question and the documents in original, if any, with regard to property in question will be returned by the complainant to the OPs at the time of last payment.
3. In case of any default in aforesaid payment, the defaulted amount shall be paid by OPs alongwith interest @ 12% p.a. from the date of default till the payment is made.
4. No TDS shall be deducted by the OPs from the aforesaid amount.

3.   The complaint is disposed of accordingly.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
