AWARD

1.   Vide his separate statement recorded on 16.11.2023, Sh.Nitesh Singhi, Counsel for OP No.1 has stated that the parties have settled the dispute amicably as per settlement deed dated 11.10.2023 Ex.CX and both the parties shall be bound by the terms and conditions as mentioned in the settlement deed dated 11.10.2023 Ex.CX. It has been further stated by counsel for OP No.1 that four post dated cheques amounting to Rs.25,00,000/- each (total Rs.1 crore) as per settlement has been handed over to the complainant, copies of which have been placed on record as Ex.CY. Vide his separate statement recorded on 16.11.2023, Sh.Harbans Lal, Complainant has admitted the aforesaid statement made by Sh.Nitesh Singhi, Counsel for OP No.1 and received four post dated cheques amounting to Rs.25,00,000/- each (total Rs.1 crore) towards full and final amount against the plot in dispute. It has been further stated by the complainant that he confirmed that the entire amount/compromise consideration has been received by him without any pressure and with his sweet will, subject to clearance of post dated cheques and prayed that complaint be disposed of in terms of settlement deed dated 11.10.2023 in National Lok Adalat. It has been further stated by complainant that he reserves his right to initiate further proceedings against OP No.1 in case amount of the post dated cheques is not released in the time stipulated in the settlement deed Ex.CX.

2.   In view of the statements made by counsel for OP No.1 as well as complainant, the complaint stands disposed of being settled in terms of settlement deed dated 11.10.2023 Ex.CX. The parties shall be bound by their statements made on 16.11.2023. The award is accordingly passed.

3.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
