Consumer Complaint No.179 of 2023

AWARD

         

          Vide separate statement recorded on 09.09.2024, the ld.Counsel for the OP Sh.Nitesh Singhi, Adv. stated that as per the instructions of MD of OP Company, the OP is ready & willing to handover the possession of the subject plot No.1353 measuring 276.67 sq. yd. to the complainant upon the payment of the pending amount/arrears of Rs.31,72,391 by the complainant which includes all the taxes & charges against the said plot on  or before 10.10.2024, failing which the complainant shall be liable to pay penal interest on the aforesaid amount @12% per annum from the date of default. He further stated that on the receipt of the aforesaid amount within the said time from the complainant, the OP shall handover the possession of the said plot to the complainant within 30 days from the receipt of amount, failing which the OP shall be liable to pay interest @12% per annum on the said paid amount to the complainant from the date of default. It is also stated that the complainant will not dispute in future with regard to the title of plot in question and this shall be towards full & final settlement of the dispute in the present consumer complaint and it be disposed of in the National Lok Adalat to be held on 14.9.2024.

 

          Vide his separate statement recorded on 9.9.2024, the ld.Counsel for the complainant Sh.N.P.Sharma, Adv. for Complainant along with complainant Mrs.Raksha Aggarwal stated that they admit the aforesaid statement of ld. Counsel for the OP and the present complaint be disposed of in the National Lok Adalat to be held on 14.9.2024 in terms of above statement/settlement.

 

2]        In view of the statements of the parties and in terms of the settlement, the complaint stands disposed of by passing the following award:-

  1. The OP is directed to handover the possession of the subject plot No.1353 measuring 276.67 sq. yd. to the complainant upon receipt of the payment of Rs.31,72,391/- from the complainant on  or before 10.10.2024. In case the complainant failed to pay the said amount by the said date, then complainant shall be liable to pay penal interest on the aforesaid amount @12% per annum from the date of default till the payment is made to OP. In case the OP failed to deliver the possession of the plot to the complainant on the receipt of the aforesaid amount within the said time then OP shall be liable to pay interest @12% per annum on the said paid amount to the complainant from the date of default apart from handing over the possession of the subject plot.

3]   The award is accordingly passed. Complaint stands disposed of accordingly.

4]   Certified copies of this order be sent to the parties free of cost. The file be consigned.
