Dt.13.10.14.                Ld advocate of the complainant is present. 

Today is fixed for admission hearing.

Heard ld advocate of the complainant.    

He submits that the OP Nos.1 & 2 of this case carry on their business from within P.S.- Bhaktinagar, Dist.- Jalpaiguri, while OP No.3 has its Head Office at New Delhi, and he has filed this case in this Forum on 25.09.2014, since, by Notification No.1754–CA/ESTT/O/5C-17/13 dated 05/08/2014, the territorial jurisdiction of this Forum comprised “All the Police Stations in the Siliguri Sub-Division under Darjeeling district including the Police Stations falling under Siliguri Police Commissionarate i.e., Siliguri, Pradhannagar, Matigara, Bagdogra, Bhaktinagar”.

However, it is seen that by Notification No.2125–CA/Estt/O/5C-17/13 dated 09/09/2014, it has been ordered that the earlier Notification No.1754–CA/ESTT/O/5C-17/13 dated 05/08/2014, will not be effected till further order.

In view of the said Notification No.2125–CA/Estt/O/5C-17/13 dated 09/09/2014, ld advocate of the complainant submits verbally that he wants to withdraw the case with permission to sue afresh. 

Prayer is allowed. 

The complainant is permitted to withdraw the case, and to sue afresh on the same cause of action before the appropriate Forum. 

Copies of this order, and the two notifications, along with the petition of complaint and its annexures, be handed over to the complainant, free of cost.
