Mr. Rajneesh Malhotra, learned counsel for appellant has stated that compromise has been arrived at between both the parties and in this regard; Memorandum of Understanding dated 29.02.2024 (Annexure-A) has also entered into and the same is being placed on record. He has sought permission to withdraw this appeal. In addition, he has further requested that statutory amount of Rs.56,000/- deposited at the time of filing of appeal may be released in favour of appellant-Kotak Mahindra Prime Limited.
2. Memorandum of Understanding dated 29.02.2024 (Annexure-A) is hereby taken on record of this appeal. In wake of above submission of Mr. Rajneesh, learned counsel for the appellants; the present appeal stands dismissed as withdrawn. As a legal corollary so flowing; Statutory amount of Rs.56,000/-/- (Rs. Fifty Six thousand only) deposited by appellants- Kotak Mahindra Prime Limited at the time of filing of present appeal be refunded to it against proper receipt, identification and verification of its representative, as per rules. It is ordered accordingly.
3. A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act, 2019. This order be also uploaded forthwith on the website of the Commission for the perusal of the parties.
4. Application(s), pending, if any, stand disposed off accordingly in terms of this order.
5. File be consigned to record room alongwith a copy of this order.
