ORDER

PER SANJEEV BATRA, PRESIDENT

1.                           The complainant has invoked the jurisdiction of this Commission by raising a consumer dispute against the OPs with regard to illegally repudiating the medi-claim cashes insurance claim of the complainant by the OPs and thus sought direction against OPs to pay the insurance claim amount along with compensation and litigation expenses etc. So, by filing the present complaint, complainant has prayed that OPs be directed to make the payment of Rs.4,00,000/- spent by him on his medical treatment. Also to pay Rs.1,00,000/- as compensation and Rs.40,000/- as litigation charges

2.                Notice was issued to the opposite parties. Today Sh. Vyom Bansal, Advocate filed power of attorney on behalf of OP1 and OP2 and suffered statement that he has been authorized by OP1 and OP2 to make the statement today in the court and the insurance company is ready and willing to settle the present complaint of the complainant for a lumpsum of Rs.3,44,000/- (Rupees Three Lac Forty Four Thousand only) in full and final settlement of the claim and redressal of the grievance pending in the present complaint. He further stated that the company will make the payment within 30 days from the date of receipt of copy of the order. 

 3.               The said offer has been duly accepted by Sh. Baljit Sharma, Advocate counsel for the complainant by suffering separate statement in this regard. Sh. Baljit Sharma, Advocate counsel on behalf of the complainant also suffered statement by accepting the offer of Rs.3,44,000/- (Rupees Three Lac Forty Four Thousand only) in full and final settlement of the claim and an award of the said amount of Rs.3,44,000/- be passed accordingly in full and final settlement of the claim and redressal of the grievance of the complainant in the present complaint for all times to come. He further suffered that the insurance company may be directed to make the payment directly in the name of complainant by way of cheque/DD.

4.                In view of the aforesaid settlement arrived between the parties, the present complaint stands disposed of with the direction that the OP1 and OP2 will pay Rs.3,44,000/- (Rupees Three Lac Forty Four Thousand only) to the complainant in full and final settlement of his claim within 30 days from the date of receipt of copy of this order failing which the complainant shall be held entitled to interest @8% per annum on the said amount till its actual payment. The award amount shall preferably be disbursed to the complainant directly through online mode/cheque/DD. Copy of the order be supplied to the parties free of costs.

5.                File be indexed and consigned to record room.
