Final Order dated 28.07.2016.

                This case has been filed by the complainant u/s 12 of the C. P. Act, 1986 praying for an order directing the Opposite Parties to pay the sum of Rs.80070 only for excess amount taken by the OPs and pay Rs.1,50,000/- only for damages, mental pain and agony.

                From the case record, it appears that several opportunities were given to both sides to file evidence but the complainant as well as the OPs did not submit the same. Lastly, the complainant was show-caused as to why the case should not be dismissed for non-prosecution but the complainant neither took steps nor filed show cause petition. It is case of refund of Rs.80, 070/- for excess amount taken by the OPs but the complainant remained silent on several dates without appearance before the Forum.

                In our opinion, the conduct of the complainant suggests that she is not interested to proceed with this case and as such we are of view that the case be dismissed for non-prosecution.

that the Consumer Complaint No. 13/2014 be and the same is hereby dismissed for non-prosecution.

There will be no order as to cost.
