Both parties filed hajira.

Today is fixed for hearing of amendment petition filed by the Complainant on 07-07-2017 which has been registered as Misc. Case No.15 of 2017.

The Misc. Case is taken up for hearing.

Ld. Lawyer for the Complainant stated that the Complainant filed this case against the three O.Ps.; but most mistakenly the name of the 3^rd O.P. has been written as Sri Biswanath Mallick in place of Sri Bholanath Mallick.  The Complainant also stated the father’s name and address of the 3^rd O.P. has not been changed.  Only the name of Sri Biswanath Mallick has to be written as Sri Bholanath Mallick.  The Complainant also stated that it was simply a typographical mistake and the nature and character of the complaint has not been changed for it.

On the other hand Ld. Lawyer for the O.P. raised verbal objection against the petition stating that Sri Biswanath Mallick and Sri Bholanath Mallick are two separate persons.

Ld. Lawyer for the Complainant stated that Complainant paid the money to Haraprasad Mallick, the O.P. no.2 and to Bholanath Mallick being the authorised persons of the Manbhum Large Sized Multipurpose co-operative Cold Storage Society Ltd. but in the cause title of the complaint the name of Sri Bholanath Mallick has been written as Sri Biswanath Mallick mistakenly.

We have heard both side and decided that it is a bonafide mistake and the nature and prayer of the petition of complaint has not been changed for such amendment.  Moreover, it is the preliminary stage of this case and W.V. has not been filed by the O.P. till now.  Therefore, the prayer of the Complainant is allowed.

Amend the cause title of the complaint.

Thus the Misc. Case no.15 of 2017 be and the same is disposed of.

To 23-04-2018 for filing W.V. by the O.P.
