-Judgement-
1. Complainant’s case in brief is that he is maintaining account No. 02671600001768 in HDFC Bank, Sector-4, B.S.City, Bokaro Branch and on 11/08/2020, 01/12/2020 and 23/08/2021 he filed applications before the Bank Manager for supply of account statements related to credit card insurance and Jumbo Loan etc. but it was not provided. Further case is that complainant filed an application by deposit of credit card no. 553533001129459 for its closure and waiver of interest etc. inspite of it there was no response by the bank officials, hence he wrote letters to Sr. Bank Officials having no impact, hence this case has been filed with prayer to direct the O.P. Branch Manager of HDFC Bank, Sector-4, B.S.City, Bokaro Branch to supply detail statements and return Rs. 35,000/- and Rs. 40,000/- deducted illegally and also to provide cost of litigation etc.
2. On due service of notice on O.P. No.1 one Rahul Kumar Relationship Manager of the Bank concerned appeared and prayed for time to file W.S. but later on no W.S. has been filed by the O.P. hence as per order dt. 27.05.2022 case has been fixed for Ex-parte hearing.
3. On careful perusal of the contents of the complaint petition it appears that there is no specific date or instance to show regarding wrongful deductions of the amount from account of the complainant. Main grievance of the complainant is that inspite of repeated requests O.P. has not provided details of the loan account as well as credit card account. It appears that for redressal of the grievance complainant has written several letters to the O.P. with due receipts on different dates as it is apparent from page-5, 6 and 7 of the annexures of the complaint petition. Similarly from page No. 1 to 4 of the annexure it is the legal notice but it has also not been replied by the O.P. It is also important to note here that inspite of due receipt of notice, O.P. has not preferred to file W.S. in this case. Therefore, we are of the view that grievance of the complainant in respect to non supply of the details of the accounts is genuine and based on papers but there is no evidence to justify the fact related to wrongful deduction of Rs. 35,000/- and Rs. 40,000/- respectively.
4 In light of above discussion prayer of the complainant is being partially allowed and O.P. Branch Manager of HDFC Bank, Sector-4, B.S.City, Branch Bokaro is directed to provide all detail statements of all the accounts of the complainant related to Jumbo Loan, Credit Card, etc., within 30 days from receipt/production of this order, failing which complainant will have liberty to pray before this Commission for taking action against the O.P. as per provision of section 72 of Consumer Protection Act. 2019. Let a copy of this order be provided free of cost to both the parties.
