ORDER

By Smt. Padmini Sudheesh, President: This is a case filed by the complainant to issue a mandatory injunction against the respondents to put up the name boards in such a manner to see the place of start and destination. According to him he is old and disability to eyesight and he is unable to read the board of buses with seconds and got into the bus. He is facing the same problem in case of K.S.R.T.C. buses also. Hence this complaint. 2. The issue of maintainability is to be decided now. 3. According to the respondent, the complaint is not maintainable before the Forum because it is not a consumer dispute and the complainant is not a consumer. 4. Section 2(1)(d) of the Consumer Protection Act defines the term consumer. The complainant is not a person comes within the purview of this definition. There is not any hiring or availing of services for a consideration also. The person who waits for buses is not a consumer. If there is violation of provisions of Motor Vehicles Act, he has to approach the concerned authorities and not the Consumer Forums. In the circumstances a detailed discussion is not necessary and the complaint is liable to be dismissed. 5. In the result, the complaint is dismissed as not maintainable. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 12th day of November 2008.
