                The complainant being the consumer has filed this complaint before this Hon’ble Forum against the O.Ps for Redressal of his grievance.  The allegation made in the complaint is with regard to deficiency in service and unfair trade practice adopted by the O.Ps.

1. The case of the complainant is that he participated in the bid conducted by Sriram Auto Mall India Ltd. on 23.02.2013 by depositing Rs.19,999/-. (Copy of the receipt Annexure-1).  The complainant came out successful in the bidding to purchase one “2009 Mahindra Bolero” with a bidding price of Rs.4,60,000/-.  It was settled between the parties that the Sriram Transport Finance Company Ltd. which is one wing of SAMIL will finance the entire bidding price and the complainant will repay same in installments with simple interest.  The complainant deposited Rs.1,14,000/- before to the finance company and  subsequently  the sale vehicle was not handed over to the complainant on the plea that the bidding amount was not paid by finance company.  The complainant could not use the vehicle even after making a payment of Rs.1,14,000/- + Rs.20,000/-.  When the petitioner requested to the company to refund the amount deposited by him, the company issued a cheque for an amount of Rs.1,14,000/- which is Rs.20,000/- less than his deposited amount.  When the petitioner demanded for the rest amount, he was told that the rest amount shall be paid by SAMIL but the O.Ps did not paid the rest amount to the complainant.  (Acknowledgement receipt Annexure-3).  Finding no other way, the complainant has taken shelter of this Hon’ble Forum.  He has prayed to direct the O.ps to refund a sum of Rs.20,000/- as paid by him.
2. The O.Ps neither attended the case nor filed any written version.

It is a fact that the complainant has get back Rs.1,14,000/- as deposited by him but not received a sum of Rs.19,999/- as deposited by him on 23.02.2013.  Since the O.Ps did not attend the case, we are constrained to believe the uncontroverted version of the complainant and the O.ps should have refunded a sum of Rs.19,999/- to the complainant, hence the O.Ps are at fault.

Exparte Order

The O.Ps are directed to refund a sum of Rs.19,999/- to the complainant within a period of 45 days from the date of receipt of copy of this order, failing which the complainant is at liberty to take shelter of this Forum against the O.Ps as per the C.P.Act,1986.
