The case of complainant is that she purchased a Maruti Wagoner Car from the 1st respondent on May 2009 for Rs.3,36,562/-. At the time of purchase the respondents made to believe that there will be cash discount of Rs.2,000/- for the professionals in the month of May. This will be refunded after verification of the documents i.e. the Degree certificate by the 1st respondent. The complainant being a practicing Homeopathic doctor having BHMS degree is eligible to get this cash discount. So the complainant submitted all the documents showing her qualification to the 1st respondent through the 2nd respondent. But the discount promised was not refunded inspite of repeated requests made by the complainant. Hence the complaint filed.
2. The respondents called absent and set exparte.
3. The complainant filed affidavit and the document produced by her is marked as Exhibit P1.
4. The complainant’s case is that she purchased a Maruti Wagoner Car on May 2009 from the 1st respondent through the 2nd respondent for Rs.3,62,562/-. At the time of purchase she was made to believe that there will be a cash discount of Rs.2,000/- to professionals on May 2009. This amount will be refunded after verifying the qualification by the 1st respondent. The complainant being a Homeopathic doctor having BHMS degree is eligible to get the cash discount. So she submitted documents showing her qualification to the 1st respondent through the 2nd respondent. But the cash discount has not been refunded inspite of several requests made by her. Exhibit P1 is the purchase bill issued at the time of purchase. Being a Homeopathic doctor the complainant deserves cash discount assured by the respondents.
5. There is no other evidence to the contrary.
6. In the result the complaint is allowed and the respondents are directed to pay the complainant Rs.2,000/- the cash discount offered with costs Rs.500/- within one month from the date of receipt of copy of the order. If not the discount amount will carry interest at the rate of 12% from the date of complaint till realization.
