ORDER

By Smt. Padmini Sudheesh, President: The case of the complainant is as follows: The second petitioner is the mother of first petitioner and 3rd and 4th petitioners are the son and daughter of the first petitioner. The petitioners as per the request of the respondents deposited an amount of Rs.1,75,000/- on 15.3.01 under the assurance that the respondents will return the amount after the period of 60 months with 12% interest. For the deposits, receipts were issued for Rs.35,000/- each in the name of petitioners. All the amount matured on 15.3.06. The petitioners had received interest up to June 2005. After that the petitioners not even received the deposit amount. The petitioners demanded the money several times, but not returned. Hence this complaint. 2. Both the respondents are called absent and set exparte. 3. To prove the case petitioners have filed affidavit and five documents, which are marked as Exts. P1 to P5. 4. According to the petitioners, they are entitled to get the deposited amount with interest. They also claim for compensation and costs. 5. There is no evidence to the contrary. 6. In the result, complaint is allowed and the respondents are directed to return the amount shown in fixed deposit receipts with interest at the rate of 12% per annum from 2005 January and 6% interest from today till realisation and also to pay Rs.1000/- (Rupees one thousand only) towards costs to the complainants. Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 24th day of 2008.
