This is a case based on a complaint filed u/s 35 of the Consumer Protection Act 2019 filed by the complainant against Managing Director, Thermotech Solutions, Thiruvanathapuram praying compensation to the tune of Rs.6,52,000/-  on various counts. 

Though notice was served, opposite party remained exparte and the case was posted for recording exparte evidence to 28.11.2022.  On that day the complainant was absent and there was no representation.  No exparte affidavit was also filed.  Hence the complaint has been posted for disposal  to this day. 

Today also the complainant called absent and exparte affidavit not filed.  In the circumstances we are of the  view that the complainant is not interested in adducing oral evidence.  The documents produced along with the complaint are copy of g-mail communication, copy of  lawyer notice, postal receipt and postal acknowledgment card.  The  above documents are not sufficient to prove the case of the complainant.  There is no evidence to substantiate the allegations in the complaint and hence the complaint is only to be dismissed.

In the result complaint stands dismissed.

          No costs.
