Complainant present and opposite parties absent, not refunded the amount as agreed by the opposite parties. Admittedly the defect arose in the warranty period. Therefore the opposite parties are directed to refund the price of the mobile phone Rs.12,000/- (Rupees twelve thousand only) to the complainant with 9% interest per annum from the date of complaint till realization. Opposite parties are further directed to pay an amount of Rs.1000/- (Rupees one thousand only) towards costs of this proceedings. The complainant is directed to return the hand set simultaneously to the opposite parties. The order shall be complied within one month from the date of receipt of this order.
