Complainant filed this consumer complaint challenging the order passed by Ld. Insurance Ombudsman, but not annexed order dt. 09.12.2022 of Ld. Insurance Ombudsman. The Complainant has also not paid the fees as required under the C.P.Act, 2019. Record put up before us today as 21 days is going to be expiry tomorrow and as U/s-36(2) of C.P.Act, 2019 the Consumer complaint is deemed to have been admitted. For challenging any claim, two options are open for a consumer either to come before DCDRC/SCDRC or to approach Insurance Ombudsman. But one can’t avail both the Forum. The Complainant having availed the Forum of Insurance Ombudsman is precluded to approach this commission. The order passed by the Ombudsman can be challenge before Honb’le High Court and as such we are not being the appellate authority dismissing the present and admission stage consumer complaint but without imposing any cost. Complainant is at liberty to approach Hon’ble High Court for due Redressal of his grievances. The C.C.Case No. 13/2024 is accordingly disposed off
