ORDER.

            The present dispute arises out of the complaint petition filed by the above named complainant  alleging deficiency in service  against the afore said O.Ps for non  payment of  pensionary  benefits after retirement from service.

The case is put up  to day for hearing on admission after office check.  It is found   the

complainant    had sent petition to this forum   by post.  The  case is posted  to   Dt.29.12.2016  for  hearing on admission. The complainant neither appeared nor furnish necessary requisites like  I.P.O  and not  taken any steps for adjournment  and  defects are not removed.

            Section 2 (i) (d) of  the  C.P. Act, 1986   defines  Consumer means any person who buys any goods  or avails of any services   for consideration he is a consumer. We observed  there is no quid proque   between the parties  in this case.

                On admission  stage, we have thoroughly examined the fact of the case of the complainant, who  was a retired employee i.e. a  Shop Supervisor and for his pensionary benefits  he had preferred this  consumer complaint. For redressal  of   grievance of  the  Co-operative employees relating to  service matter, there is a Co-operartive  Tribunal, where he can agitate his grievance for its redressal .    The  Managing Director, Tribal Development Co-operative Corporation of Odisha Ltd., Near Rupali Square, Bhoinagar, Bhubaneswar- 22  whom he was working is neither the service provider nor the  complainant who was  Shop Supervisor is a consumer.  Further the complainant  prays for claim amount in his petition  is Rs.33,00,000/- which is  beyond the jurisdiction of this forum.  In that view of the matter at the admission  stage, we  dismissed the complaint petition.

So  to meet the  ends of justice    the following order is passed.

ORDER.

            In the result with these observations, findings, discussion  the complainant  is free to approach the court having  jurisdiction to his  grievances.   Parties are left to bear their own cost.  Accordingly the case  is closed.
