This is a case based on a consumer complaint filed u/s 12 of the Consumer protection Act against the Managing Director, Kerala Water Authority, Thiruvananthapuram and Assistant Executive Engineer, Kerala Water Authority, Chavara section. The matter was taken up today at the settlement. The son of the complainant, the learned counsel for the complainant, the 2nd opposite party Assistant Executive Engineer, Kerala Water Authority and the learned counsel appearing for the opposite parties present. Talk held. The learned counsel for the complainant would submit that the complainant has received bill cum demand and disconnection notice dated 20.06.19 claiming Rs.25062/-. It is further alleged that KWA has not taken meter reading for 87 months which is a long period and hence there is lapse on the side of the KWA and that the bill amount is highly excessive. The learned counsel for the Water Authority would submit that after issuing demand cum disconnection notice the customer has used water supplied of KWA only for 3 months and the highest consumption is 18.5 K.L per month. In the circumstance we are of the view that KWA is to reduce the amount by considering the monthly consumption as 18.5 K.L per month for the last 87 months. If that be so the complainant has to pay Rs.11268/- upto January 2021. The learned counsel for the complainant would further submit that the complainant no longer requires water connection of the KWA and prays to disconnect the water connection from the premises of the complainant. If the complainant actually intends to disconnect the water connection she has to file a petition to that effect signed and disconnection charge of Rs.65/- has also to be paid in addition to Rs.11268/-. In short both parties are amenable for the above terms suggested by this Commission. In the result the matter is settled in the following terms.
The complainant shall pay Rs.11333/- (11268+ disconnection charge Rs.65/-) within 7 days from today as full and final settlement. The complainant shall also file a petition seeking to disconnect the water connection from her premises. If the 2nd opposite party received the above amount being the arrears of water connection and disconnection petition and charge, shall permanently disconnect the water connection from the premises of the complainant and no claim shall be raised in future. Report compliance on or before 17.03.2021.
