Brief facts of the complaint:-

 

Complainant joined in a Kuri conducted by the opposite parties and  full amount was paid towards the Chitty.  When  he approached the opposite party company  for the chitty amount, it is seen that the company has been closed.     Hence complainant claiming the amount paid along with interest, cost & compensation. 

 

Opposite party filed a statement stating as per Section 446 of the Companies Act, No Court can proceed against the company when a winding up order has been passed and official liquidator appointed.  Judgment of Hon’ble  High Court also produced.

 

Both parties heard regarding the preliminary issue.  As per the order of the Hon’ble High Court, it is seen that the opposite party company has been wind up and official liquidator has been appointed.  In view of the said circumstances, the complainant has to approach the official liquidator for relief.  Hence complaint dismissed with direction to approach the official liquidator for relief.

 

Pronounced in the open court on this the 31st  day of  October 2011.
