This Revision Petition is listed today and, after hearing the arguments of the counsel for the Revision Petitioner and upon perusing the materials on record, this Commission passes the following:-

This Revision Petition is filed against the Order, dated 16.10.2019 passed by the DCDRC, Tiruppur in C.C. No.189/2022 whereby, the District Commission has set the Revision Petitioner herein/ 1st Opposite party exparte for non-filing of proof affidavit.
2. Heard the Revision Petitioner / 1st Opposite party. There was no representation for the 1st respondent / complainant.

Since, the Revision Petitioner / 1st Opposite party has failed to appear and file proof affidavit and the District Commission had set the Revision Petitioner herein / 1st opposite party exparte on 16.10.2019. When the matter had come up before this Commission, the Learned Counsel for the Revision Petitioner /1st Opposite party stated that since the Counsel appearing for Revision Petitioner / 1st opposite party was not feeling well, he could not appear before District Commission on 16.10.2019 to file proof affidavit. The non-appearance of the Revision Petitioner / 1st Opposite party is neither willful nor wanton. Thus, he prays for setting aside the exparte order dated:16.10.2019. Irrespective of the reason assigned by the Revision Petitioner, we are of the opinion that in the interest of justice, this Revision Petition could be allowed by setting aside the impugned order so that the Revision Petitioner / 1st opposite party will have a chance of conducting the case on merits.
4. In the result, the Revision Petition is allowed and the impugned order, dated 16.10.2019, passed in C.C. No.189/2022 by the DCDRC, Tiruppur in setting the Revision Petitioner / 1st Opposite party exparte is set aside, and the 1st Opposite Party shall file his Proof Affidavit and the documents/exhibits on their side, if any, in C.C. No.189/2022 on the next date of hearing without fail, whereupon, the District Commission shall proceed with the case in accordance with law, for its early disposal.
