               This Execution Application  is coming for hearing before us on 10^th  day of  October, 2019 in  the presence of Mr.R.Palanimuthu, Counsel for Petitioner/Complainant, Thiru. R. Manohoran, Counsel for the Respondent 1/ Opposite party 1, Mr.M.R. JothiBass, Counsel for the Respondent 2/Opposite party 2, and Respondent 3/opposite party 3 was set exparte and the Petition having stood over to this day for consideration,   this Forum passed the following:

ORDER

            This petition is taken up today by Suo-Moto. Petitioner/Complainant is present. The Counsel for Respondent present. The Opposite Party 1/ Respondent 1 is Present. Settlement Memo is filed by the Petitioner and stated that the subject matter of the EA amount is settled in out of forum by the Respondent 1/Opposite party 1 and also request the forum may be dismiss this petition. In view of the above versions averred in the settlement memo, this E.A.No.3/2018 in C.C.36/2017 is dismissed as settled in out of forum. Hence, the settlement memo is recorded.

 Further, the N.B.W pending against the Respondent 1/Opposite party 1 is ordered to be withdrawn and therefore the N.B.W is hereby cancelled.

Hence ,the order is accordingly.
