Heard the appellant in person, Mr. Amit Seth, son of the appellant and Mr. Lalit Bhasin, learned counsel for the respondent hospital. After the matter was argued at some length, Mr. Lalit Bhasin, learned counsel for the respondent hospital states that without prejudice to its rights and contentions and purely on humanitarian and compassionate ground, the respondent hospital would pay a further amount of Rs.1,10,000/- to the appellant/complainant in addition to the amount of Rs.1,10,000/- already paid to her in terms of the order of the State Commission provided the appellant is willing to withdraw the allegations of medical negligence made in the complaint as well as in the appeal. The offer made by him is acceptable to the ..2.. appellant/complainant. Statement of the appellant, Smt. Usha Seth has been separately recorded which will form the part of this order. The appeal is disposed of in terms of the settlement reached between the parties. The respondent hospital shall pay a further sum of Rs.1,10,000/- to the appellant/complainant by means of demand draft within a period of three weeks from today. I hereby withdraw all the allegations of medical negligence made by me in the complaint before the State Commission.
