ORDER BY HON’BLE MEMBER- MRS. M. SWAIN:

                                                                                                 JUDGMENT

            Complainant purchased a vehicle taking financial help from the opposite parties i.e. Hinduja Layland Finance Company. Complainant took the loan from opposite parties vide loan A/c No.ORCUJS00054 from 07.9.2015 to 07.6.2019 with loan amount of Rs.18,00,000/- and interest Rs.5,00,400/- grand total Rs.23,00,400/- to be repaid in 46 monthly installment @ Rs.50,009/- each. The complainant purchased the vehicle to increase the livelihood of her family and the vehicle is registered vide Regd. No.OD-21-C-2954. The complainant paid all her installment but the opposite parties did not give her NOC, hence this complaint.

            The opposite parties submitted in their written version and mentioned that Rs.1,98,964/- is pending as EMI outstanding as on 06.11.2019 against the loan account of the complainant and total outstanding as reflected in her statement of accounts is annexed herewith as Annexure-2, but actually there is no Annexure-2 with the statement. For which this Commission cannot differentiate from the pending amount of Rs.1,98,964/- mention in the written version.

            This is an old case and the agreement has already expired since 07.6.2019.

            We therefore direct that the opposite parties shall issue NOC to the complainant if there is no pending EMI of complainant i.e. from Rs.1,98,964/-. Opposite parties shall intimate to the complainant within 15 days after receipt of order through registered post regarding any pending EMI and opposite parties shall deduct 2/3^rd of the overdue interest from any pending amount. The entire process shall be completed within 45 days from the date of receipt of the order. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
