The case of the complainant precisely is that she had applied for a new electricity connection with the OPs through Online mode on 1.11.2021, to be installed at her residence at Vrinda Cottage No.26 (One BHK House), Pushpajali Baikunth, Phase-1, Vrindavan (Uttar Pradesh) under Jhatpat Connection Scheme of Utter Pradesh Power Corporation Ltd. and deposited processing fee of Rs.118/- (Ann.C-2). It is submitted that according to Jhatpat Connection Scheme, the complainant had completed all the required formalities and requested the OPs to arrange the site visit on priority and Issue/install the New Electricity Connection/Meter, but none turned up for the site inspection. However, the OP NO.2 asked her to submit the "No Objectin Certificate" (NOC) of the builder against the consumption of Electricity but the builder of Pushpanjali Baikunth is not providing the "No Dues Certificate' (NDC) despite clear dues. It is stated that OP No.2 & 3 were requested to direct the builder to provide the NDC when the Complainant has paid all the dues, but nothing was done by OP NO.2 & OP No.3. It is submitted that an e-mail was also sent to OP No.2 on 19.11.2021, followed by reminders, to direct the builder to issue the NDC when sufficient surplus amount is available in Pre-paid Meter and to install the New Electricity Meter by using the official powers but to no avail. Hence this complaint has been preferred alleging the aforesaid acts as deficiency in service and unfair trade practice on the part of OPs.
2] The OPs No.1 to 3 did not turn up despite service of notices, hence they were proceeded exparte vide order dated 6.9.2022.
3] Complainant led evidence in support of her contentions.
4] We have heard the representative of the complainant and gone through the entire evidence and documents on record.
5] The complainant is seeking new electricity connection of his flat/house situated in the State of Uttar Pradesh on the ground that she has deposited the processing fee for that with the OPs. The complainant herself admitted in the complaint that concerned Electricity Department of State of Uttar Pradesh demanded No Due Certificate of Builder from her in order to get new electricity connection, which the Builder is not issuing despite surplus amount from her side.
6] In our opinion the complainant by mere deposit of processing fee against her application does not become consumer qua OPs till the electricity connection is not granted in her name. More so, the complainant has to complete the requirement of the OPs to get the requisite connection and the OPs are not supposed to act on her instructions with the third party or to grant the connection merely on getting processing fee. In any case, if the complainant has any grouse against the Builder or the OPs, for that she has other efficacious remedies available under the law.
7] For the reasons stated above, the complaint stands dismissed being devoid of any merit. No order as to costs.
