          Attendance on behalf of o.ps has been filed. The learned lawyer for the o.ps submits to dismiss this Misc. case as the same is not maintainable before this forum and the complainant  is not taking any interest.

            perused the record. On perusal, it transpires that the applicant (complainant) has filed this Misc. petition to recall the  order dated 23-06-2015 passed in original complaint Case No.-57/2012. The complainant is regularly absent since 27-02-2019. He has been directed to take proper step but he is taking no interest to take part in hearing. 

             In the case of Rajiv Hitrendra Pathak V/s Achut Kashi Nath Kayaker civil appeal No.- 4307/2007 dated 09-08-2011, Hob’ble Supreme Court of India has observed  that this  forum has  got no power to review, recall or restore its own order.

          In the circumstances this Misc. petition is dismissed.
