Sh.Bhartendu Sood, the complainant has stated that he invested Rs.2.00 lacs with Ansal Properties and Infrastructure Ltd. in Fixed Deposit Scheme on 27.2.2013. As per the scheme, the Opposite Party has to pay quarterly interest on the invested amount @12.5%. The complainant has stated that for the quarter ending on 31.3.2016, he was paid only Rs.3531/- by the Opposite Party i.e. short of Rs.2200/-. The complainant has claimed Rs.2200/- with further interest thereon upto the time of its payment.
2] The notice was issued to the Opposite party. Sh.Rachit Kaushal, Advocate appeared before this Forum on behalf of the Opposite Party on 18.7.2016 but despite several opportunities, no reply or evidence filed. The matter was listed on 15.9.2016 and the case was called several times, but none appeared on behalf of the Opposite Party and hence proceeded exparte.
3] Complainant led evidence in support of his contentions.
4] We have heard the complainant in person and perused the entire record produced by him in support of his claim.
5] The Deposit Receipt (Anx.I) shows that Bhartendu Sood, the complainant has invested Rs.2.00 lacs in Fixed Deposit Scheme on 27.2.2013. As per the Deposit Receipt, the policy was for a period of 36 months i.e. with effect from 27.2.2013 to 26.2.2016. The Fixed Deposit Scheme matured on 26.2.2016, resultantly, the interest @12.5% quarterly payable on the deposited amount, also stops accruing thereon on 26.2.2016 itself.
6] The Opposite Party has correctly calculated and paid the interest amount upto 26.2.2016. Thus no cause of action arose to the complainant to claim any interest on the amount after the date of maturity of the Fixed Deposit Scheme on 26.2.2016. Therefore, the claim of the complainant for interest upto 31.3.2016 is frivolous. The complainant is not entitled for any relief as claimed for.
7] The complaint filed by the complainant is without merits and hence hereby dismissed.
The certified copy of this order be sent to the parties free of charge, after which the file be consigned.
