Put up in National Lok Adalat.
Learned counsel Smt. Anjali Gusain for the complainants as well as brief holder Sh. Arjun Sirohi, Advocate of senior counsel Sh. T.S. Bindra, Advocate for opposite party has appeared.
A perusal of the order sheet dated 10.11.2022 has shown that the compromise has already been filed, signed and accepted by both the parties alongwith counsel and authorized signatory, which has already been kept on record.
In the light of the aforesaid compromise, the complaint case is hereby decided.
The compromise (paper No. 114 & 115) shall form part of the decree.
It is orally averred on behalf of the opposite party that the possession of the apartment will be handed over to the petitioners after white wash.
It is directed to that the complainant/petitioners shall pay a sum of Rs. 10,00,000/- (Rupees Ten Lacs only) to the opposite party as full and final payment within one and a half month from today; the opposite party – Hansmukhi Project Ltd. will hand over the completed apartment on receipt of Rs. 10,00,000/- (Rupees Ten Lacs only) from the complainant/petitioners and the possession of the apartment will be given to the complainant/petitioners on the receipt of Rs. 10,00,000/- (Rupees Ten Lacs only) immediately and without any delay.
It is also directed to the opposite party that the company will not have any lien on the apartment after the payment of Rs. 10,00,000/- (Rupees Ten Lacs only) and transfer the possession of the apartment to the complainant/petitioners; the title of the of apartment shall be transferred immediately to the complainant/petitioners by executing sale deed/lease deed as the case may be, at the expenses of the complainants / petitioners.
Both the parties are borne their own costs.
