SRI.P.V.JAYARAJAN : PRESIDENT
1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The opposite parties 1 to 3 entered appearance and filed written version denying the allegations raised by the complainant. On 25/09/2023 when the case came up for consideration both parties submitted that there is a chance of settlement and hence the matter was referred for mediation. When the first mediation held on 21/10/2023, the matter was not settled and hence the case was adjourned to this date for proceeding further with the complaint. When the case came up for consideration today, the complainant filed a memo stating that the opposite parties have repaid the cost of the machine ie Rs.31,850/- (Rupees thirty one thousand eight hundred and fifty only) vide cheque No.850889 dated 02/11/2023 and in that memo he further stated that in view of the final settlement, the complainant has got no further claim against the opposite parties and hence he is not willing to further proceed with this complaint. The memo filed by the complainant is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.
In the result, the complaint is dismissed as settled. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
