Heard the counsel for the complainant. The complainant is filed seeking three reliefs. The first one is for a declaration that opposite parties 1 and 2 are not entitled to realize certain amount from the complainant. The 2^nd one is for recovery of money and the 3^rd one is for an injunction retraining Revenue Recovery Proceedings. There is absolutely no averment in the complaint regarding any deficiency in service. When the complainants claim is not based upon deficiency in service and he is seeking to recover money the complainant is not cognizable by the Consumer Forum (III 1994 (1) CPR 459). So 2^nd prayer is not cognizable. For granting reliefs of declaration and injunction restraining RR proceedings also this Forum has no jurisdiction. Hence the complaint is dismissed.
