JUDGMENT
Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking following reliefs;
“Direct the opposite parties to make proper assessment of the installment of complainant and O.P. No.1 receive a sum of Rs.1,96,034/- from complainant towards rest loan amount and hand over relevant documents and pay Rs.75,000/- towards loss in business, Rs.10,000/- for mental agony due to loss of reputation, Rs.5,000/- cost towards running to the office of the opposite parties and Rs.5,000/- cost of litigation”.
The brief fact of the complainant is that, the complainant purchased a vehicle on loan from opposite party No.1 on 30.11.2011. For the purchase of the aforesaid vehicle, the complainant paid a sum of Rs.3,00,000/- as down payment and received Rs.16,19,000/- as loan amount and the loan amount was sanction by opposite party No.1. as per the agreement, complainant has to pay Rs.46,000/- as installment every month and the installment started from 05.01.2012 till 05.11.2015 for 47 months. After availing loan the complainant has paid a sum of Rs.19,98,100/- towards installment of total amount of Rs.21,94,134/- (Rs.16,19,000/- principal amount + Rs.5,75,136/- interest). So the complainant has only to pay a sum of Rs.1,96,034/- rest of installment amount to the opposite party No.1. Due to illegal activities of opposite party no.2 & 3 complainant sustained a loss of Rs.75,000/- in business as he could not use his vehicle.
Notice was issued to opposite parties but they are set ex-parte on 09.11.2021.
Counsel for complainant is also repeatedly absent since two years. From the documents filed by the complainant we are not convince regarding the details of the case. Both the parties are callous in their attitude, we have given several adjournments expecting the cooperation from either of the party. But none of parties turned up to co-operate us in disposing the case. Hence the consumer complaint is dismissed for non prosecution with liberty to file fresh complaint by filing better petition if so advised. Accordingly the consumer complaint is disposed of.
