ORDER

 

SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  After admitting the complaint notice was issued to the opposite party.  The opposite party entered appearance and filed written version denying the allegation raised by the complainant.  When the case came up for consideration on 22/05/2024, both parties submitted that there is a chance of settlement and hence the matter was referred for mediation.  When the case came up for consideration today, both parties submitted that the matter is settled.  The compromise memo signed by both parties is also filed before this Commission.  As per the compromise the opposite party has agreed to pay a sum of Rs.4,700/- to the complainant and in turn the complainant agreed to return the disputed saree to the opposite party.  The full and final settlement amount Rs.4,700/-is paid to the complainant by the opposite party.  The compromise memo filed by the parties to the proceedings is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is fit case to be allowed in terms of compromise.

In the result the complaint is allowed in terms of compromise.  The compromise memo dated 02/03/2024 shall form part of this order.  There will be no order as to cost.    

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
