Today is fixed for S/R. In spite of several directions, the Complainant has not been filing requisites for the issuance of notice upon the OP. The record shows that the Complainant was found absent on call on 22.12.22, 03.04.23, 09.06.23,18.08.23, 08.11.23, 22.02.24, 13.06.24 and today i.e. on 19.06.24. The Complainant Rituparna Tribedi filed the instant case praying for giving direction to the OP to prepare proper accounting and also for giving direction to pay Rs. 1,00,000/- for mental pain and agony and Rs. 1,00,000/- for harassment cost and also to restrain the OP to take over the possession of the vehicle forcibly from the custody of the Complainant. But the Complainant has not been filing requisites for long period. The Complainant has also been absent for long period. Such being the position, we are of the view that the instant case has no merit and as such the Complainant is not at all interested in the instant case. The instant case is liable to be dismissed. Hence, it is Ordered that the complaint Case No. CC/77/22 be and the same is dismissed on merit against the OPs. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
