ORDER
SRI.P.V.JAYARAJAN: PRESIDENT
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. The opposite parties entered appearance and filed written version denying the allegation raised by the complainant. Since 31/03/2020 this case was adjourned for the affidavit of the complainant. As the complainant was continuously absent, this Commission issued a notice to the complainant to appear before this Commission on 27/04/2022 to further proceed with this complaint. The notice issued to the complainant was returned with endorsement ‘addressee no more’. Hence this Commission adjourned the case to this date, for ascertaining whether any legal heirs of deceased complainant are interested to further proceed with this complaint. When the case came up for consideration today, none of the legal heirs of deceased complainant approached this Commission to implead themselves to further proceed with this complaint. In the above circumstances we find that this is a fit case to be dismissed as abated.
In the result complaint is dismissed as abated. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
