The complainant’s case is as follows: On 6.10.05 the complainant had deposited Rs.30,000/- vide 48 units as per receipt No.94667 in the respondent’s firm. The respondents had offered that the deposited amount will be doubled in a year. But the respondents never returned the deposited amount till this date. The act of the respondents shows deficiency in service and unfair trade practice. A lawyer notice was sent on 18.6.09. But no remedy so far. Hence the complaint.
2. The respondents remained exparte.
3. To prove the case of the complainant he filed affidavit and produced Exts. P1 to P3 documents.
4. According to the complainant he had deposited Rs.30,000/- in the respondent firm on 6.10.05. The respondents offered double deposited amount in a year. But he did not receive the said amount till this date.
5. There is no evidence to the contrary.
6. Ext. P1 shows that the complainant had deposited Rs.30,000/- on 6.10.05. The due date and the conditions offered are not mentioned in the Ext. P1 receipt. He demanded the deposited amount by sending a lawyer notice on 18.6.09. So he is entitled to get the Ext. P1 amount with 12% interest.
7. In the result the complaint is allowed and the respondents are directed to pay Ext. P1 amount with interest at the rate of 12% per annum from 6.10.05 till realization along with Rs.500/- (Rupees five hundred only) as costs to the complainant within one month from the date of receipt of copy of this order.
