SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  After admitting the complaint notice was issued to the opposite party.  The opposite party entered appearance and filed written version denying the allegation raised by the complainant.  When the case came up for consideration on 24/11/2022 both parties submitted that the matter is settled for Rs.3,000/- and the opposite party has agreed to issue NOC in favour of the complainant within 15 days from that date.  Hence the case was adjourned to 15/12/2022 and 23/12/2022 respectively for reporting settlement.  When the case   came up for consideration today, the complainant filed a memo stating that the matter is settled and he is not willing to further proceed with this complaint.  The memo of settlement filed by the complainant is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled. 

                        In the result complaint is dismissed as settled.  There will be no order as to cost.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
