This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service and unfair trade practice on the part of the opposite party. After admitting the complaint, notice was issued to the opposite party. The said notice was accepted by the opposite party on 14/06/2023. Subsequently the opposite party failed to appear before this Commission and not filed written version and hence on 29/07/2023, the opposite party was called absent and set ex parte. Since 10/10/2023, this case is posted for filling proof affidavit of the complainant. After filing this complaint the complainant was continuously absent since 04/07/2023 and there was no representation from the side of the complainant. Inspite of giving sufficient opportunities, the complainant failed to appear before this Commission and file proof affidavit to substantiate the allegation raised by the complainant. In the absence of any affidavit from the side of the complainant, there is no piece of evidence before this Commission to substantiate the allegation raised by the complainant against the opposite party. In view of the above discussions, we find that this is a fit case to be dismissed for want of evidence.
In the result the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
